By accessing or using Tooned, you confirm that you are at least 18 years of age and legally able to enter into these Terms. If you use the Service on behalf of a business, you represent that you have the authority to bind that entity to these Terms.

Tooned provides vehicle research, market analysis, negotiation guidance, contract review, maintenance tracking, a vehicle marketplace, and valuation tools, offered free of charge. We also offer a one-time Advocate service, where a Tooned representative assists you through the vehicle purchase process.

• The Advocate service is a one-time fee (currently $899 CAD) for end-to-end advocacy support.
• Payments are processed securely by Stripe. Tooned does not store your full card details.
• Fees are non-refundable once work has begun, except where required by applicable Canadian law. See our Refund Policy for full details.

Our tools generate estimates, analyses, and guidance based on available data and are provided for informational purposes only. Tooned's outputs are not professional financial, legal, mechanical, or insurance advice, and do not constitute a guarantee of any outcome. Vehicle values, market data, and listing information may be inaccurate or incomplete. Always verify critical information independently and consult a qualified professional before making significant financial decisions.

The Advocate service provides personalised assistance with vehicle sourcing, negotiation, and related tasks. While we act in your interest, outcomes depend on factors outside our control, including dealer behaviour and market conditions. We do not guarantee a specific purchase price or outcome.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current information when creating your account and using the Service.

• You will not misuse the Service or attempt to access it in unauthorized ways.
• You will not reverse-engineer, scrape, or attempt to extract our models or underlying data.
• You will not use the Service for any unlawful purpose or in violation of these Terms.
• You will not submit false, misleading, or infringing information.

The Service integrates with third-party platforms, including vehicle listing sources and Stripe for payments. Tooned is not responsible for the accuracy, availability, or practices of third-party services. Listing data, prices, and vehicle details originate from external sources and may change without notice.

All content, branding, software, and materials on Tooned are owned by Tooned or its licensors and protected by intellectual property laws. You may not copy, redistribute, or create derivative works without our written permission.

To the maximum extent permitted by law, Tooned and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the amount you have paid us in the preceding twelve (12) months.

You agree to indemnify and hold Tooned harmless from claims, damages, and expenses arising from your misuse of the Service or violation of these Terms.

We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time.

We may update these Terms from time to time. We will post the revised Terms with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Canada and the Province of British Columbia, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of British Columbia.

• Tooned may offer a referral program under which existing users can share a personal referral link or code with others.
• Referral rewards, where offered, are issued as one-time promotional credit codes with no cash value, are non-transferable, and cannot be combined, sold, or exchanged for cash.
• Rewards are issued at our discretion once the eligibility conditions displayed on the Referrals page at the time of referral are met, and may take a reasonable time to process.
• We may modify, suspend, or discontinue the referral program, or decline or reverse rewards, at any time, including in cases of suspected fraud, abuse, self-referral, or violation of these Terms.
